There are agencies that help you fight copyright violators and help you prove this. You can deposit brands, logos and such with people that actively search for violations of this copyright. But this are just aides.

In the letter of the law copyright is implicit and immediate upon publishing. As soon as you create something and publish it, regardless of medium, it is copyrighted.

The internet has plenty of free material including your logo.... in order to tolerate this you have to face the fact that free stuff on the internet (this inclueds models) will be stolen some time with copy Right laws or not.

Where does it say that material on the internet is 'free'? This notion is falsely clung onto by the ignorant. Even on internet national and international laws apply, which includes copyright laws.

Also, if you read the disclaimer on the main site you know that "...all material created by our clan members is their property...", which includes the CDG logo, articles written by us, etc.

The fact that material will get ripped is a statistical fact. This is nothing new to me. It has happened on several occasions in the past and on one occassion I decided to fight it and won.

But what I simply don't understand is why people don't even take the effort just to simply ask first. how hard is it to open your mail client and write 1 paragraph of text to ask if it's ok. Doing anything else is showing great disrespect towards me and everyone else who has created materials.

10 Big Myths about copyright explained wrote:
1) "If it doesn't have a copyright notice, it's not copyrighted."
This was true in the past, but today almost all major nations follow the Berne copyright convention. For example, in the USA, almost everything created privately and originally after April 1, 1989 is copyrighted and protected whether it has a notice or not.

So in an extend to that material created today in most countries is subject to implicit copyright laws based on the Berne copyright convention.

Brad Templeton basically supports everything I've said about copyright and most of what was posted on whatiscopyright.org as well. It's also good to remember that copyright isn't the same all over the world (although most western nations follow the Berne copyright convention).

It is true that in order to sue for monetary damages several governments require you to deposit your work, but this is not required in all countries. Depositing material is a sure way to win copyright issues in a legal sense, but that does not mean that copyright does not exist before you deposit it.

out of curiousity---what do you mean you'd ''burn him down?'' like sue him or just ban him? just wondering. like if you banned him he'd probably come back under a different name, but if you were to sue him if it [teh logo] was indeed under copyright that'd be different.

Just FYI he'd probably ban his IP or get onto his ISP about his activities rather than ban his nick.

As to what I mean with burning someone down depends on his willingness to cooperate. But I would go a lot further than just banning him from the forums.

Have you gone the lengths to get legal copy right protection for the logo? It may be something that you should consider.
